DUI Defense Attorney Serving Massachusetts
Drunk driving cases often focus on constitutional and scientific issues. The Law Offices of Judith A. Wayne & Associates. Wayne understands these issues and will put the evidence against you to the test: was it properly obtained and is it scientifically valid? We have won many drunk driving cases over the years because the evidence used by the prosecution did not meet these tests.
Our firm is led by DUI defense lawyer Judith Wayne, a former assistant district attorney for Middlesex County. We understand how local police and prosecutors handle OUI/DWI/DUI cases. We defend clients who have been arrested for operating under the influence throughout Massachusetts, including the Boston area and the North Shore. We are also prepared to handle cases from as far west as Pittsfield and as far east as Cape Cod and the Islands.

Improper Police Stops
Police cannot generally pull you over unless they have a valid reason for the stop. If you were stopped for an illegal reason, all evidence gained after the stop (including the field sobriety test and the Breathalyzer test results) can be suppressed.
Challenging the Validity of Sobriety Tests
Certain field sobriety tests, including the horizontal gaze nystagmus test, can be challenged in court. In the horizontal gaze nystagmus (HGN) test, the police officer uses a pen to track eye movements. However, most officers who conduct this test are not considered experts, and can incorrectly administer the test. We have won several cases based on the cross-examination of officers who have misused the horizontal gaze nystagmus test.
Breathalyzer test results can also be challenged based on technical problems with the machine or if the officer was not properly trained in its operation.
Protecting Your Driver’s License
Anyone who is arrested for drunk driving in Massachusetts faces both criminal charges and a civil driver’s license revocation. The Law Offices of Judith A. Wayne & Associates. Wayne has the ability to represent you in both the criminal and administrative cases. If your driver’s license is suspended, we can help you apply for a hardship license to drive to and from work.
It is important to keep in mind that you should never drive when your license have been revoked or suspended — driving on a suspended license is a serious crime in Massachusetts, subject to mandatory jail time.
